SampleStore Terms and Conditions

§ 1 Preliminary Provisions

  1. The SampleStore online store, available at the internet address samplestore.pl, is operated by Michał Sokołowski, Śródlesie 15-378, ul. Cisowa 3, NIP: 9662184771, REGON: 526885830, entered into the Central Register and Information on Economic Activity (CEIDG).
  2. These terms and conditions are addressed to Consumers and define the rules and procedure for concluding a distance Sales Agreement with the Consumer via the Store.
 

§ 2 Definitions

  1. Consumer – a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
  2. Personal Data Controller – samplestore.pl.
  3. Client – any entity making purchases through the Store.
  4. Entrepreneur – a natural person, a legal person, or an organizational unit without legal personality, to which a separate act grants legal capacity, conducting business activity in its own name, who uses the Store.
  5. Store – the online store operated by the Seller at the internet address samplestore.pl.
  6. Distance Contract – a contract concluded with the Client within an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to the moment the contract is concluded.
  7. Terms and Conditions – these regulations of the Store.
  8. Order – the Client’s declaration of intent made via the Order Form, aimed directly at concluding a Product Sales Agreement with the Seller.
  9. Account – the Client’s account in the Store, where the Client’s data and information about the Orders placed by them in the Store are collected.
  10. Registration Form – a form available in the Store that allows for the creation of an Account.
  11. Order Form – a form available in the Store that allows for the placement of an Order.
  12. Cart – an element of the Store’s software in which the Products selected by the Client for purchase are visible, including the possibility to determine and modify the Order details.
  13. Product – a movable item/service available in the Store that is the subject of a Sales Agreement between the Client and the Seller.
  14. Sales Agreement – a product sales agreement concluded or entered into between the Client and the Seller via the Online Store.
 

§ 3 Contact with the Store

  4. The Client may communicate with the Seller using the addresses and phone numbers provided in this paragraph.
  5. The Client may communicate with the Seller by phone between 9:00 AM and 4:00 PM (CET).
 

§ 4 Technical Requirements

To use the Store, including browsing the Store’s assortment and placing orders for Products, the following are necessary:

  1. A terminal device with access to the Internet and a web browser.
  2. An active electronic mail (e-mail) account.
  3. Enabled cookies support.
 

§ 5 General Information

  1. To the fullest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Client’s technical infrastructure.
  2. Browsing the Store’s assortment does not require creating an Account. Placing orders by the Client for Products in the Store’s assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.
  3. Prices given in the Store are expressed in Polish Zlotys (PLN) and are gross prices (including VAT).
  4. The final (total) amount to be paid by the Client consists of the price for the Product and the delivery cost (including fees for transport, delivery, and postal services), of which the Client is informed on the Store’s pages during the placement of the Order, including at the time of expressing the will to be bound by the Sales Agreement.
  5. When the nature of the subject of the Agreement does not allow, reasonably judging, for the earlier calculation of the final (total) price, information on the manner in which the price will be calculated, as well as on fees for transport, delivery, postal services, and other costs, will be provided in the Store in the Product description.
 

§ 6 Creating an Account in the Store

  1. To create an Account in the Store, the Registration Form must be completed. It is necessary to provide the following data: first name, last name, e-mail address, phone number.
  2. Creating an Account in the Store is free of charge.
  3. Logging into the Account is done by entering the login and password established in the Registration Form.
  4. The Client has the option to delete the Account at any time, without giving a reason and without incurring any fees, by sending a relevant request to the Seller, in particular via e-mail.
 

§ 7 Rules for Placing an Order

In order to place an Order, you should:

  1. Select the Product that is the subject of the Order and then click the “Add to Cart” button.
  2. Log in or use the option to place an Order without registration.
  3. If the option to place an Order without registration was chosen – fill in the Order Form by entering the details of the recipient of the Order and the address to which the Product is to be delivered, and select the type of shipment (method of delivery).
  4. Click the “Order and Pay” button, choose one of the available payment methods and, depending on the payment method, pay for the Order within the specified period, subject to § 8 point 3.
 

§ 8 Offered Delivery and Payment Methods

  1. The Client (depending on the Product) may use the following methods of delivery or collection of the ordered Product:
    • Courier shipment.
    • Personal collection at the address indicated in § 3 point 1.
  2. The entities providing online payment services for card payments are Stripe, Klarna, and PayNaw. The Client may use the following payment methods:

    Electronic payments:

    • BLIK,
    • Fast transfers,
    • Google Pay,
    • Apple Pay,
    • Klarna,
    • Others.
     

    Payment cards:

    • Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.
    • The entity providing online payment services for card payments is Autopay S.A.
  3. Detailed information on delivery methods and acceptable payment methods can be found on the Store’s website.
 

§ 9 Execution of the Sales Agreement

  1. The conclusion of the Sales Agreement between the Client and the Seller takes place after the Client has placed an Order using the Order Form in the Online Store in accordance with § 7 of the Terms and Conditions.
  2. After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution takes place by the Seller sending the Client a relevant e-mail message to the Client’s e-mail address provided during the placement of the Order, which contains at least the Seller’s statements about receiving the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail message by the Client, the Sales Agreement between the Client and the Seller is concluded.
  3. In case the Client chooses:
    • Payment by transfer, electronic payments, or payment card, the Client is obliged to make the payment within 24 hours from the moment of concluding the Sales Agreement – otherwise, the order will be canceled.
    • Payment upon personal collection, the Client is obliged to make the payment upon personal collection.
  4. The Product will be sent by the Seller within the period indicated in its description (subject to paragraph 5 of this section), in the manner chosen by the Client during the placement of the Order.
  5. In the case of ordering Products with different readiness dates for collection, the readiness date for collection is the longest given date.
  6. Delivery of the Product takes place within the territory of Poland.
  7. Delivery of the Product to the Client is subject to a fee, unless the Sales Agreement provides otherwise. Product delivery costs (including transport, delivery, and postal service fees) are indicated to the Client on the Online Store’s pages in the “Delivery Costs” tab and during the placement of the Order, including at the time of the Client’s expression of the will to be bound by the Sales Agreement.
 

§ 10 Withdrawal from the Contract

  1. Right to withdraw from the contract:
    1. The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
    2. The period specified in section 1 begins from the delivery of the Product to the Consumer or a person designated by them other than the carrier.
    3. In the case of an Agreement that includes many Products delivered separately, in batches, or in parts, the period indicated in section 1 runs from the delivery of the last item, batch, or part.
    4. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the deadline expires.
    5. The statement may be sent electronically by sending the statement to the Seller’s e-mail address or by submitting a statement on the website via the contact form. The Seller’s contact details are specified in § 3.
    6. For a full refund, it is important that you return the product in its original condition and undamaged. Make sure the product is properly and securely packaged for the return shipment. If we receive the product damaged or incomplete, we may deduct money from the amount to be refunded.
  2. Effects of withdrawal from the contract:
    1. In the case of withdrawal from a Distance Contract, the Contract is considered null and void.
    2. In the case of withdrawal, the Seller shall return to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumer’s statement of withdrawal, all payments made by them, including the costs of delivering the item, except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest ordinary delivery method offered by the Seller.
    3. The Seller will reimburse the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has explicitly agreed to another solution that will not involve any costs for them.
    4. The Seller may withhold the reimbursement until receipt of the Product back.
    5. The Consumer should send the Product back to the Seller’s address provided in these Terms and Conditions immediately, no later than 14 days from the day they informed the Seller about the withdrawal.
    6. The Consumer bears the direct costs of returning the Product.
  3. Exclusion of the right to withdraw: The Consumer does not have the right to withdraw from the contract in cases specified by law, including when the subject of the contract is an item made to order, sealed products after opening, or digital content not delivered on a tangible medium.
 

§ 11 Complaint and Warranty

  1. The Sales Agreement covers new Products.
  2. In the event of a defect in the goods purchased from the Seller, the Client has the right to make a complaint based on the provisions regarding the warranty (rękojmia) specified in the Civil Code.
  3. Complaints should be submitted in writing or electronically to the Seller’s addresses provided in these Terms and Conditions.
    1. It is recommended to include a brief description of the defect, the circumstances (including the date) of its occurrence, the details of the Client making the complaint, and the Client’s request in connection with the defect.
  4. The Seller will respond to the complaint request immediately, no later than within 14 days.
 

§ 12 Out-of-court Dispute Resolution

  1. Detailed information on the possibility for the Consumer to use out-of-court complaint and redress methods is available at the offices and on the websites of district (municipal) consumer ombudsmen and the Office of Competition and Consumer Protection (UOKiK).
  2. The Consumer has the right to apply to a permanent amicable consumer court or the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings.
 

§ 13 Personal Data in the Online Store

  1. The controller of the Clients’ personal data collected via the Online Store is the Seller.
  2. Personal data is collected for the purpose of executing the Sales Agreement and, if the Client consents, for marketing purposes.
  3. The Client has the right to access and correct their data.
  4. Providing personal data is voluntary but necessary to conclude a Sales Agreement.
 

§ 14 Final Provisions

  1. Contracts concluded through the Online Store are concluded in the Polish language (with this English version provided for convenience).
  2. The Seller reserves the right to make changes to the Terms and Conditions for important reasons, such as changes in law or changes in payment and delivery methods.
  3. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply.
